1. Acceptance of Terms

By accessing and using SMART-TiLL ("the Service"), including our web application and mobile applications for Android and iOS, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms apply to all users of SMART-TiLL, whether accessed through our web platform or mobile applications available on Google Play Store or Apple App Store.

2. Use License

Permission is granted to use SMART-TiLL for personal or commercial purposes through our web platform and mobile applications. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials or source code
  • Use the materials for any commercial purpose outside of its intended use as a point of sale system
  • Attempt to decompile, reverse engineer, or disassemble any software contained in SMART-TiLL
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the license to another person or redistribute the software
  • Use automated systems or bots to access the Service without authorization
  • Interfere with or disrupt the Service or servers connected to the Service
  • Extract data from the Service for competitive purposes

Mobile Application License: Your license to use our mobile applications is limited to a non-transferable, non-exclusive license to use the mobile application on devices that you own or control, subject to these Terms and the terms of the respective app stores (Google Play Store or Apple App Store).

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your computer, mobile device, and account
  • All activities that occur under your account or password
  • Ensuring all information provided during registration is accurate and current
  • Securing your mobile device with appropriate lock mechanisms (PIN, fingerprint, face recognition, etc.)
  • Not sharing your authentication credentials with unauthorized persons
  • Immediately notifying us of any unauthorized access to your account

4. Service Description

SMART-TiLL provides a cloud-based point of sale system available through our web platform and mobile applications (Android and iOS) that includes:

  • Sales management and processing
  • Inventory tracking and management
  • Customer relationship management
  • Reporting and analytics with visual charts and graphs
  • Multi-store support
  • Cash management and tracking (cash in hand, cash collection)
  • FBR integration (where applicable)
  • Dashboard with real-time statistics
  • Low stock alerts and notifications

The Service is accessible through multiple platforms:

  • Web Platform: Accessible through web browsers on desktop and tablet devices
  • Mobile Applications: Available for download from Google Play Store (Android) and Apple App Store (iOS)

5. Payment Terms

Certain features of the Service may require payment of fees. You agree to pay all fees associated with your account. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees at any time with 30 days notice.

6. Data Backup and Security

While we implement reasonable security measures to protect your data, we recommend that you:

  • Regularly backup your important data
  • Use strong passwords and enable two-factor authentication where available
  • Monitor your account for unauthorized access
  • Keep your mobile applications updated to the latest version
  • Secure your mobile devices with appropriate lock mechanisms
  • Log out from shared or public devices
  • Notify us immediately if you suspect any security breach

Cash Management Responsibility: You are solely responsible for managing and securing cash transactions within your store. While we provide tools to track cash in hand and cash collection, you are responsible for:

  • Verifying cash amounts before collection
  • Maintaining accurate cash records
  • Securing physical cash on your premises
  • Reconciling cash transactions regularly

We are not liable for any loss of data, cash, or financial loss resulting from unauthorized access, hardware failure, user error, or any other cause.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend access to the Service for:

  • Scheduled maintenance
  • Emergency repairs
  • Technical issues beyond our control
  • Mobile app updates or maintenance
  • Third-party service provider outages

Mobile Application Updates: We may release updates to our mobile applications from time to time. These updates may include bug fixes, new features, or security improvements. You are responsible for keeping your mobile applications updated. We are not responsible for issues arising from using outdated versions of the mobile applications.

App Store Terms: When downloading our mobile applications from Google Play Store or Apple App Store, you also agree to comply with their respective terms of service and policies.

8. Limitation of Liability

In no event shall SMART-TiLL or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use SMART-TiLL, even if SMART-TiLL or a SMART-TiLL authorized representative has been notified orally or in writing of the possibility of such damage.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Upon termination, we will provide you with an export of your data in a commonly used format.

10. Mobile Application Terms

App Store Compliance: Our mobile applications are distributed through Google Play Store and Apple App Store. By downloading and using our mobile applications, you agree to:

  • Comply with the terms of service of Google Play Store or Apple App Store, as applicable
  • Use the mobile applications only on devices that you own or control
  • Not attempt to modify, reverse engineer, or create derivative works of the mobile applications
  • Accept automatic updates to the mobile applications when available

Device Requirements: Our mobile applications require an active internet connection to function. You are responsible for:

  • Maintaining internet connectivity on your device
  • Any data charges or fees associated with using the mobile applications
  • Ensuring your device meets the minimum system requirements

Mobile App Security: Authentication tokens and sensitive data are stored securely on your device using platform-specific secure storage mechanisms. You are responsible for maintaining the security of your device.

11. Compliance with Laws

You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations, including but not limited to tax laws, FBR regulations (in Pakistan), and data protection laws.

12. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service (including in-app notifications for mobile applications). Your continued use of the Service after such modifications constitutes your acceptance of the new terms.

13. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SMART-TiLL and its licensors. The Service is protected by copyright, trademark, and other laws. This includes but is not limited to:

  • The web platform and all its components
  • Mobile applications for Android and iOS
  • Software code, designs, graphics, and user interfaces
  • Branding, logos, and trademarks

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
